How luxury real estate on the Costa Brava varies north to south

The northern coast around Cadaqués, Port de la Selva and Roses combines tramuntana wind, protected landscapes and winding roads. Check legal access, vehicle turning, parking, water, wastewater, fire exposure and whether a route to the sea crosses public, protected or third-party land. Cap de Creus proximity is not a substitute for permission.

The notary performs statutory checks and authorises the public deed, but does not replace buyer-side counsel, an architect, surveyor, engineer or valuation specialist. Verify community debts, IBI, energy certificate, occupancy, planning records, beneficial ownership and payment instructions through known professional channels.

Coastal and municipal planning evidence

Use MUC to identify the apparent planning framework, then open the full legally published documents in the Catalan Urban Planning Registry, RPUC. The 2021 Girona coastal PDU reviews the sustainability of planned urban land across 22 municipalities. Its inclusion of a municipality does not tell a buyer that a particular plot remains developable or that an extension will be approved.

Municipal records are decisive to the parcel. Palafrugell publishes POUM plans for Tamariu, Calella de Palafrugell and Llafranc as well as urban, rural and services mapping. Begur, Cadaqués, Pals, Roses and every other municipality have separate instruments and case histories. Ask an architect to trace classification, uses, setbacks, height, coverage, heritage or coastal overlays, licences, completion, first occupation and every alteration.

Commission inspection of slope, retaining walls, drainage, waterproofing, salt corrosion, roofs, pool, utilities, wastewater and fire access. Qualified professionals should assess woodland and water constraints. Refurbishment is not evidence that works were authorised; follow the controls for luxury new developments where relevant.

Tourist-home permission cannot be assumed

Catalonia's Decree-Law 3/2023 applies an additional framework in 262 municipalities with housing-access pressure or more than five tourist homes per 100 residents. In listed municipalities, official guidance says a new activity needs prior municipal planning permission and tourism authorisation; the licence lasts five years and may be renewable under the then-current plan. Municipalities must adapt their planning, and the cap is not a promise that licences are available.

Begur expressly states that the tourist communication cannot be filed before a favourable prior planning licence. Existing registry entries, advertisements or past revenue do not prove transferability, renewal or full compliance. Obtain a dated municipal and legal opinion for the exact dwelling.
