Off-Market Property Lake Como

A private introduction should disclose who instructed the intermediary and what the owner has authorised for release. Restricted circulation does not prove exclusivity, clean title or lawful lake access. The data room should distinguish the registered dwelling, gardens, ancillary buildings, parking, access rights and any shore facility. A photograph of a pontoon does not prove that it belongs to the property or benefits from a current concession.

Title, Cadastre and Binding Documents

The buyer's notary examines ownership, mortgages, seizures, easements, pre-emption issues and the proposed conveyance. Agenzia delle Entrate provides cadastral and real-estate registry services, but a visura catastale alone should not be treated as a complete title or legality opinion. Reconcile the deed, registry searches, cadastral plan and actual layout, including cellars, terraces, guest houses and boundary walls.

A proposta d'acquisto or contratto preliminare can bind the parties before the final deed. Conditions should address satisfactory diligence, specified documents, release of mortgages and treatment of the deposit. Planning, Landscape and Historic Fabric

Regione Lombardia's PGTWEB publishes municipal planning documents, while SIBA helps locate protected landscapes under the Cultural Heritage and Landscape Code. SIBA expressly says its data are indicative rather than probative. The appointed technician must retrieve the current municipal plan, original constraint acts, planning and building titles, habitability or related records, approved plans and any landscape authorisations.

For a historic villa, verify whether the building, garden, gates, trees or setting have cultural or landscape protection. Compare every extension, enclosed loggia, lift, pool and service building with approvals; a renovation may still need remediation or may not be regularisable.

Road, Slope and Shore Diligence

Lake roads and old village approaches can make practical access as important as floor area. Test the legal easement and the physical route separately: gate width, gradient, retaining walls, drainage, turning space, delivery access, construction staging and emergency reach. A car reaching the house during a viewing does not prove a registered right of way or year-round suitability.

For shoreline property, map the cadastral boundary against the public lake domain. The Autorità di Bacino del Lario e dei Laghi Minori operates a procedure for concessions to use demanio lacuale areas. Confirm the concession holder, permitted structure and use, duration, fees, transfer or renewal position and compliance of works. “Private lake access” must not be advertised until those elements are evidenced.

Slope stability, rockfall, flooding and lake-level exposure require site-specific assessment. Insurance and seasonal navigation are separate checks.

Tax, Foreign Eligibility and Short Lets

Italian taxes differ according to seller, buyer, asset and whether VAT or registration tax applies. Ask the notary and tax adviser for a dated calculation covering purchase, mortgage and cadastral taxes, professional fees, annual IMU where relevant, waste charges and succession or holding implications.
