The brief should name the exact parcel and locality, not only “south coast” or a beach. Ornos, Agios Ioannis, Aleomandra, Psarou and inland plots differ in roads, exposure, utilities and planning context. Each presentation needs cadastral identifiers, approved floor area, access, water and wastewater arrangements and completion status.
Title, Boundaries and Transfer File
Buyer-appointed Greek counsel and the notary should review title history, seller authority, mortgages, claims, easements and cadastral status. The Hellenic Cadastre's digital map can show parcel boundaries and KAEK references, but online viewing is not a substitute for the current cadastral sheet, diagram and transaction-grade certificates. A surveyor must compare the registered geometry with walls, roads and the occupied site.
Reconcile the property description and area used for E9/ENFIA with the title and technical record. A reservation must state diligence conditions, deposit treatment, document deadlines and the result of adverse title, access or building findings. Seller summaries do not replace original records.
Building Identity and Planning Status
An authorised engineer should retrieve the building permit, revisions, approved drawings, declarations concerning unauthorised works and the Electronic Building Identity or divided-property identity. The Extract or Certificate of Completeness does not remove the need to inspect the actual villa. Pools, pergolas, retaining walls, guest rooms, plant areas and enclosed terraces must match the legal file.
Mykonos has an evolving Special Urban Plan process. Draft scenarios and consultation maps are not transaction clearance. Use the binding rules effective on the diligence date, checked through competent planning services and YPEN's e-Planning information. For an out-of-plan parcel, obtain a written technical opinion on buildability, minimum conditions, coastline or stream constraints, protected status and the relevance of frontage on a legally recognised public road.
Archaeology, Coast and Traditional Fabric
Gov.gr provides an Archaeological Cadastre, and the Ephorate of Antiquities of the Cyclades has jurisdiction over Mykonos. Its own island account identifies ancient remains in several localities. A blank map result should not be treated as approval: counsel and the engineer must determine whether an archaeological site, protection zone, chance-find process or prior opinion affects the parcel and planned work.
Also check official shoreline boundaries, traditional-settlement or listed-building records and architectural controls. A path to the sea does not establish private beach ownership. Excavation or utility work can require separate approvals.
Road, Wind, Water and Wastewater
Access must work legally and physically. Verify the deeded easement or public-road basis, gate and lane width, gradient, bends, retaining walls, parking, delivery turning, emergency reach and rights to improve the route. A driver reaching the villa once is not proof that heavy maintenance vehicles or guests can do so safely.
The Hellenic National Meteorological Service notes that seasonal northerly Etesian winds affect the Aegean. Site exposure varies by ridge, bay and building orientation. A structural and building-envelope review should test roofs, shutters, glazing, pergolas, external furniture, salt corrosion, pool operation and sheltered outdoor zones rather than relying on a generic “protected” claim.
DEYAM is responsible for municipal water and wastewater services and operates treatment and pumping infrastructure. Confirm whether the parcel has lawful active connections, meter capacity and paid accounts; do not assume every villa is on both networks. Record storage tanks, pumps, delivered or desalinated water reliance, wastewater connection or lawful on-site system, maintenance access and summer demand.
Tax and Lawful Short-Term Use
Greek counsel and a tax adviser should prepare a current schedule for transfer tax, notarial and cadastral charges, engineering work, annual ENFIA where applicable, insurance and operating costs. Buyer status and holding structure require individual advice. Purchasing does not automatically confer a visa, residence permit, rental income or capital gain.
AADE says a qualifying short-term operator registers the property, obtains a Property Register Number and shows it on digital platforms, then files stay declarations. These tax steps do not cure title, planning or safety defects. Confirm current national accommodation standards, local restrictions, manager status, insurance and guest reporting before advertising. A separate property management mandate can cover inspections and systems, while private-client legal and tax coordination can align regulated advice.
